Hemp is a variety of the Cannabis plant that contains legally compliant levels of THC. The legal distinction between Hemp and Marijuana changes according to the THC content, with Hemp legally defined as containing equal to
0.3% Δ9THC or less than on a dry weight basis.

Is Δ8THC Federally Legal?

The answer is yes! Delta 8 THC may have an intimidating name, based on what the general public have been trained to think over the past more than 90 years
regarding it's counterpart: Delta 9 THC (which is not federally legal).
Delta 8 THC is federally legal and legal in most states in the USA thanks to

H.R. 2: The Agricultural Improvement Act of 2018,

also known as the 2018 Farm Bill.

The 2018 Farm Bill specifically made all derivatives, isomers, and cannabinoids found in Hemp legal, provided the final product has less than 0.3% Delta 9 THC.
For reference, Delta 8 THC is an isomer of CBD, a derivative of hemp and CBD, a Cannabinoid discovered in Hemp, and is ultimately contained in our extracts with less than 0.3% Delta 9 THC.

We often get asked about the Federal Analogue Act, which is part of the Controlled Substances Act, because Delta 8 THC is listed. This is where the 2018 Farm Bill is especially helpful, as it also includes an amendment to the Controlled Substances Act, explicitly excluding all tetrahydrocannabinols found in Hemp.

The 2018 Farm Bill in the United States legalized the cultivation and sale of Hemp and the derivative products, including Cannabinoids such as
Delta-8-THC and CBD, as long as they meet the legal criteria. As such, our consumable Cannabinoid products are sourced from naturally grown Hemp plants and undergo extraction processes to isolate and concentrate the desired Cannabinoids within legally compliant levels.

It's important to note that the legality of Cannabinoids can vary by jurisdiction, and regulations are subject to change.
While the 2018 Farm Bill provides a federal framework, individual states may have different laws and restrictions regarding Delta-8-THC and it's Cannabinoid counterparts.
